Responsibility: Active Gourmet Holidays, LLC, its employees, shareholders, subsidiaries, affiliates, officers, directors and assigns (collectively “AGH”) does not own or operate any entity which is to or does provide goods or services for your trip, including, for example, lodging facilities, transportation companies, local ground handlers, tour operators, cooks, food service or entertainment providers, etc. As a result, AGH is not liable for any negligent or willful act or failure to act of any such person, or of any other third party not under its direct control. Without limiting the foregoing, AGH accepts no responsibility for any risk or resulting injury, delay, inconvenience, damage, or death which results from criminal activity, weather or other acts of God, acts of government, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, accidents, disease or sickness, epidemics or the threat thereof, illness, the provision of inappropriate or no medical attention or the lack of access to same, the demands of indoor or outdoor activities, strikes, political or civil unrest, attacks or bites by animals, pests or insects, overbooking, structural or other defective conditions in hotels or other lodging facilities, acts of terrorism or the threat thereof, insurrection or revolt, or any other event beyond its direct control. In addition, AGH is not responsible for typographical or substantive errors in descriptions of hotels or trips.
Booking Fees: AGH charges a $50 per person booking fee for most tours, with the exception of one day cooking classes or tours, in which case the booking fee is $20 per household. Booking fees are non-refundable in the event of an operator or client cancellation. Booking fees are waived for repeat clients.
Credit Card Payments: Website program fees reflect a 3.5% discount for payments made via money order or check. Payments using credit cards are not entitled to the money order or check discount so a 3.5% fee will be recalculated. In the event of a cancellation by client or operator, this fee is non-refundable.
Deposits: Deposits vary according to which program client has reserved. Please check web page of program to see amount of deposit due. Full payment is due at time of booking for non-residential day or evening cooking classes and day excursions/tours.
Pricing and Final Payments: AGH reserves the right to re-calculate pricing and/or final payments due to exchange rates and fluctuations in the market between time of initial inquiry/deposit and time of balance due date.
Returned Checks: A $25 fee will be charged for all returned checks.
Wiring Funds: If paying by a wire/bank transfer, client is responsible for all source bank fees, intermediary bank and wiring fees. Please add $40 for international wire transfers.
Cancellation Policy: The terms and conditions of a cancellation by client(s) are subject to each individual operator’s or Hotel’s policy. AGH assumes no responsibility should client or operator/hotel cancel for any reason. Upon booking, client should inquire about the Hotel’s or operator’s terms and conditions of the program in which he/she is enrolled. Operators/Hotels reserve the right to cancel a
Program, and in most cases their liability will be limited to refunding all money paid. Should client re-book a tour he or she has cancelled, AGH/Operator/Hotel reserves the right to recalculate any extra monies due depending on market fluctuations between the time of original booking and rebooking.
Acceptance into Trip : AGH reserves the right to decline to accept any applicant to its programs and to terminate any participant's participation on a trip if continuation thereof may, in AGH's sole judgment, be detrimental to the passenger's health or welfare of that of other trip members.
Travel and Trip Cancellation Insurance: We highly recommend protecting yourself with travel insurance. AGH offers insurance through Travelex Insurance Services, (800) 228-9792 (please use our agent code: 07-0064). Travelex will be happy to help you with suggestions on coverage. AGH/Operator/Hotel is not responsible for monies lost due to client cancellation if travel insurance is not purchased.
Adjustments or Refunds: No refunds will be given for any unused portions of any programs/tours/courses. Client must make AGH and program operator aware of any complaints before the end of client’s stay to give hotel/operator a chance to remedy any problem.
Not Included: Airfare, insurance, additional excursions not outlined in itineraries, personal expenses, phone calls, faxes, laundry services, passport and visa fees and in most cases, tips and gratuities (unless otherwise noted on specific itinerary).
Arbitration: I agree that any dispute concerning, relating, or referring to this contract, the brochure, or any other literature concerning my trip, or the trip itself shall be resolved exclusively by binding arbitration in Connecticut according to the then existing commercial rules of the American Arbritration Association. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable.
Number of People on Program: AGH is not responsible for the number of clients on any particular program.
Cancellations by AGH: AGH can cancel any program for any reason at any time. In the event AGH cancels a program, its only obligation to participant is to refund all monies collected from said participant for said program.
Photography Release: Participant grants the right to AGH to use photographs, film, video, images, text, testimonials or other likenesses of participant for its own commercial use without compensation to participant.
Itineraries: Program itineraries may vary from time to time due to the season and seasonal ingredients, schedules of local activities/festivals or local conditions. Operators reserve the right to modify the menus/schedule when necessary. Operators and AGH are not responsible for any modifications in itinerary. Please inquire within regarding specific itinerary.
Missed Features of Program: In case a participant chooses not to utilize any aspect(s) of the program, he or she is not entitled to any refund therefore. In the event some aspect of the program becomes unavailable through no fault of AGH, participant agrees its only recourse is to obtain a refund directly from the tour operator/hotel.
